RailNetEurope (RNE), following the work of its Commercial Conditions Task Force, has launched a stakeholder engagement initiative to gather feedback on the draft Guidelines for the modulation of penalties related to changes of capacity rights.
Background and context
This initiative is part of the ongoing development of the European Framework for Capacity Management (EFCM), which aims to establish a harmonised approach to railway capacity management across Europe.
In this context, stakeholder engagement activities give sector stakeholders the opportunity to be actively involved in shaping key regulatory and operational elements before their formal adoption.
The draft Guidelines for the modulation of penalties address the requirements set out in Article 42 of Regulation (EU) 2026/1184, which introduces a harmonised penalty mechanism for significant changes to capacity rights.
Stakeholder input
Stakeholders are invited to provide structured feedback on the draft guidelines’ chapters with focus on the key obligation of the Regulation.
It is also possible to send more general comments to ensure that all relevant perspectives are considered.
The feedback collection will end on 31 August 2026. All contributions will be analysed by RNE experts and considered in refining the Guidelines before their formal incorporation within the EFCM consultation process planned by early 2027.
